§ 42-63. Removal from rotation list.

  • In the event it is determined that a service is not in compliance with this article, the city shall provide notice to the service and remove the service from rotation. Removal from rotation will be by the chief of police or his designee. If removed from rotation, the wrecker service may within ten days appeal the decision to the city manager. The decision of the city manager will be final. Services may be removed from the rotation list for the following reasons:

    (1)

    Excessive unresolved complaints.

    (2)

    Unsatisfactory response for service requested by the police department or the city.

    (3)

    Failure to comply with any part of this article or state laws.

    (4)

    Complaints of excessive fees.

    (5)

    Any business practice that reflects discredit upon the city or the police department as an endorsing agency.

    (6)

    Any other good and just cause.
