§ 10-35. Review of application by city council.

  • (a)

    Any application which the mayor and city council determines as satisfying all the qualifications outlined in this article, including character requirements as contained in the report of the city chief of police, shall be scheduled for review at the next meeting of the city council.

    (b)

    At that meeting, the applicant and any person opposed to the application has the right to present to the city council any information which the city council determines is relevant to the licensing decision.

    (c)

    In making its determination on whether to approve or deny the application, the city council shall look to the public interest and welfare and shall have the sole discretion to grant or deny the application based on the information presented.

    (d)

    A decision by the city council shall be made within 30 days from the date of the city council meeting, and notice of that decision shall be mailed to the applicant. In the event the application is denied, the written notification shall set forth in reasonable detail the reason for the denial and shall notify the applicant of his right to appeal; the appeal to be in accordance with the provisions of this chapter.
